Defense attorney in Maradona death trial case claims evidence was “tampered with”

Rodolfo Baqué, the defense attorney for nurse Gisella Madrid, who was in charge of caring for Diego Maradona, has told Argentinean media that there was “adulterated evidence” in the room where the former player died, in his house in Tigre, province of Buenos Aires.


Baqué said that the photos taken in the house where Maradona died show a room that was “suspiciously tidy” hours after his death, since, according to the lawyer, “Diego died at 1:00 p.m. (16:00 GMT) and at 4:00 p.m. (19:00 GMT) there were already alterations at the scene."


Baqué said that during the first minutes after Maradona’s death, his client spent a little over an hour “trying to revive him” alongside one of the security guards who was giving him mouth-to-mouth resuscitation. “There were other doctors and paramedics there, along with a bunch of other people who couldn’t have not disturbed the scene,” Baqué said in statements to the A24 channel.


Another of the lawyers who participated in this media complaint was Mario Baudry, who represents Verónica Ojeda - mother of ‘Dieguito’ Fernando Maradona - plaintiff in the case for the death of the world champion. “The evidence (photos) that are in the file are those that the prosecutors consider useful to make an accusation,” said Baudry.


At the moment, neither the court nor the prosecutor’s office investigating Maradona’s death have confirmed the statements of the defender or the plaintiff.

When is the trial investigating Maradona’s death?


On October 2, the Buenos Aires Court of Cassation established that responsibility for Maradona’s death will be defined in two instances: one by jury against the nurse - at Baqué‘s request - although it has no start date, and another technical trial for the rest of the seven defendants, which is scheduled for March 11, 2025.


“I don’t know if the trial of the nurse by popular jury will be held,” Baqué admitted, adding that the same situation could occur with the ordinary trial in which the other seven professionals are accused. The other defendants are neurosurgeon Leopoldo Luque, psychiatrist Agustina Cosachov, psychologist Carlos Díaz, nurse Ricardo Omar Almirón, clinical doctor Pedro Di Spagna, doctor Nancy Forlini (who coordinated the home care of the former soccer star), and the coordinator of nurses, Mariano Perroni.


The Argentine justice system is expected to begin a trial next March against the team that cared for the former footballer in his final days, which is being investigated for alleged medical negligence.


Maradona died on November 25, 2020 as a result of “acute pulmonary edema secondary to exacerbated chronic heart failure,” according to the autopsy, and “dilated cardiomyopathy” was discovered in his heart.
